A Lei CLARITY deveria definir quem regulamenta as cripto nos Estados Unidos. Em vez disso, o Senado impediu o seu avanço — e os reguladores não estão mais esperando. O presidente da SEC, Paul Atkins, e o presidente da CFTC, Michael Selig, estão agora avançando com novas regras para cripto usando poderes que suas agências já possuem.

A mudança tornou-se óbvia quase imediatamente após a votação no Senado. Atkins prometeu ação “com ou sem legislação”. Selig disse que a CFTC estava “preparada e pronta para lançar” suas regras. Em dois dias, a SEC abriu uma nova rota para a negociação de ações tokenizadas, enquanto uma ampla regulamentação do mercado de cripto da CFTC apareceu no sistema de revisão regulatória da Casa Branca.

Em 15 de setembro, o Senado votou 49-50 contra a invocação de cloture na moção para prosseguir com a Lei de Clareza do Mercado de Ativos Digitais (Digital Asset Market Clarity Act). Sessenta votos eram necessários.

A votação não encerrou permanentemente o projeto de lei. O senador republicano Thom Tillis votou contra o cloture especificamente para poder apresentar uma moção de reconsideração, deixando um caminho processual para outra votação. Mas a janela legislativa em 2026 é agora extremamente estreita.
