US SEC to Hold Meeting, Proposes Allowing Crypto Projects to Raise Funds Without Full Securities Registration

The U.S. Securities and Exchange Commission (SEC) will hold a public meeting on August 14 to consider proposing a "Regulation Crypto" rule framework that would allow certain crypto projects to raise funds without completing full securities registration. If public comment is initiated, this would mark the SEC's first formal, long-term rulemaking specifically for the crypto industry. The framework proposes a path to exit SEC oversight: if project developers stop actively managing the project after fundraising and the project achieves decentralization, it could be released from SEC jurisdiction. SEC Chair Paul Atkins previously stated that the relevant exemption period could last up to four years, but the announcement did not disclose fundraising thresholds. The U.S. Senate did not advance the Digital Asset Market Clarity Act before its August recess. The final rule will still take several months to complete, with the meeting scheduled for 10:00 AM ET on August 14.

U.S. District Judge Rules Kalshi Sports Contracts Are Not Swaps; CFTC Lacks Exclusive Jurisdiction

Judge Vernon D. Oliver of the U.S. District Court for Connecticut dismissed Kalshi's motion for a preliminary injunction, ruling that its sports event contracts do not constitute swaps under the Commodity Exchange Act. The CFTC therefore does not have exclusive jurisdiction over them.

The ruling noted that sports event contracts account for 80% to 90% of Kalshi's listed contracts and revenue, and that the CFTC has never reviewed any of these contracts under the relevant special rules. Oliver held that match outcomes are event outcomes, not separate events.

CFTC Orders Kalshi to Continue Operating Prediction Market in New York After State AG Lawsuit

The U.S. Commodity Futures Trading Commission (CFTC) announced it has directed prediction market operator Kalshi to continue operating in New York. This follows a lawsuit filed against the company by New York Attorney General Letitia James in late July seeking to shut down the platform.

The CFTC stated that after Kalshi sought assistance, the regulator invoked its "emergency powers" to require the company to continue operations.

Bitwise Cuts 14% of Staff, Manages Approximately $9 Billion in AUM

Digital asset manager Bitwise Asset Management has reduced its workforce from approximately 180 to about 155 employees, a reduction of roughly 14%. Bitcoin News reported that a new technical analysis released by @KLoaec shows that some vulnerable COLDCARD Mk3 wallets may be generated from only ~4.5 million possible RNG starting states, which can be searched in approximately 3 seconds on a single RTX 4090 GPU. Even accounting for additional uncertainty in how each wallet is generated, an attacker could complete the search in about 50 minutes on a single high-end GPU. More seriously, this vulnerability could cause different devices to generate identical seed phrases.
