On August 31, Thailand’s SEC proposed rules that would allow intermediaries to offer certain foreign digital asset derivatives to retail clients.

The Thai regulator is opting for a controlled environment rather than outright bans. Key conditions and restrictions include:

  • foreign instruments must be traded exclusively on exchanges with a central counterparty for clearing and be under the supervision of regulators that are part of recognized international organizations;
  • foreign products (in terms of underlying assets, leverage, maturity, and settlement methods) must be similar to derivatives permitted in Thailand’s domestic market;
  • crypto derivatives that do not meet these strict criteria will only be offered to institutional investors who have the resources to independently assess risks.

On March 5, 2026, the SEC recognized cryptocurrencies and digital tokens as permissible underlying assets for derivatives. The regulator is discussing the parameters of future contracts with the Thailand Futures Exchange.

Why this matters

The proposal could expand Thai retail investors’ access to overseas crypto derivatives while routing that access through regulated intermediaries and centrally cleared venues. It signals a regulatory framework that permits broader participation but retains limits on products that do not meet domestic-equivalence and oversight standards.

Public consultations on the new bill will continue until September 30, 2026, after which the SEC will finalize the regulations and likely announce the effective date.

Earlier, in August 2026, Thailand prepared rules for spot ETFs on Bitcoin and Ethereum.

Previously, in May, Thailand planned to launch a 100 MW hydrogen data center.
