CFTC Crypto Rulemaking Reaches White House

The U.S. Commodity Futures Trading Commission has sent its CFTC crypto rulemaking package to the White House for review, marking the first formal regulatory step since the Senate rejected the CLARITY Act

The filing, titled "Regulation Crypto Asset Transactions and Regulation Crypto Asset Markets," reached the Office of Information and Regulatory Affairs (OIRA) on September 17, 2026

As of this writing, the action sits at the early "prerule" stage, meaning the actual text is not yet public.

Why Did CFTC Send Its Crypto Rule to White House Review?

Crypto reporter Eleanor Terrett first flagged the filing on X, noting it landed just two days after CFTC Chairman Michael Selig said the agency was "locked in and ready to ship rules" following the Senate's failed CLARITY Act vote.

The CFTC crypto rule White House submission follows Selig's repeated public commitment to use the commission's existing statutory authority if Congress cannot deliver a market structure law.

What Is CFTC Regulation Crypto Asset Transactions and Markets?

The filing carries RIN 3038-AF80 and is subject to the Dodd-Frank Wall Street Reform and Consumer Protection Act. It has not yet disclosed which exchanges, tokens, or intermediaries would fall under its scope.
