“La CFTC está preparada y lista para lanzar sus normas para la nueva frontera de las finanzas”, escribió el presidente de la CFTC, Mike Selig, en una publicación en X tras la votación del miércoles. 

La CFTC, el viernes, también publicó una carta de no acción, brindando a ciertos proveedores de software una forma de conectar a los usuarios con mercados de derivados regulados sin registrarse como agentes introductores. Cubre software pasivo que permite a los usuarios ver mercados y enviar órdenes directamente a firmas registradas, incluso a través de billeteras cripto.

Los proveedores pueden comercializar contratos específicos y recibir comisiones basadas en transacciones, pero no pueden retener activos de clientes, generar señales de compra o venta ni controlar cómo se enrutan o ejecutan las órdenes, según la carta.

El alivio viene con condiciones, incluyendo divulgaciones de riesgo, mantenimiento de registros y cumplimiento de las normas de marketing. Se mantiene vigente hasta que la CFTC adopte normas o directrices que aborden los requisitos de registro para los desarrolladores de software.

Why this matters

The CFTC’s move signals a potentially consequential shift in how software providers that connect users to regulated derivatives markets, including through crypto wallets, are treated under U.S. registration rules. The temporary relief could reduce compliance barriers for qualifying providers, while its conditions and eventual replacement by formal rules leave the operating framework subject to change.
