Bitcoin is struggling for momentum around US$63,000 as setbacks for cryptocurrency regulation in Washington and renewed outflows from US spot Bitcoin exchange-traded funds weigh on market sentiment.

The world's largest cryptocurrency was trading at about US$63,044 on August 17, having traded between roughly US$62,670 and US$63,310 during the session.

Bitcoin has retreated from around US$65,000 at the beginning of last week, with investors contending with delays to proposed US digital asset legislation as well as weaker institutional fund flows.

CLARITY Act pushed back

Much of the regulatory focus is on the Digital Asset Market Clarity Act, or CLARITY Act, which is intended to establish a clearer regulatory structure for cryptocurrency markets in the US.

The US Senate went into its August recess without advancing the legislation, despite the bill being one of the crypto industry's main policy priorities.

Senate Majority Leader John Thune has indicated lawmakers intend to return to the legislation in September, although the approaching November midterm elections leave a narrowing window for Congress to reach an agreement this year.

The legislation would more clearly divide responsibility for digital assets between US financial regulators and potentially move much cryptocurrency trading outside the jurisdiction of the Securities and Exchange Commission.

Political disagreements, however, continue to complicate negotiations over the final shape of the legislation.

SEC cancels crypto meeting

Regulatory uncertainty was compounded when the US Securities and Exchange Commission (SEC) cancelled an open meeting scheduled for August 14.

Commissioners had been due to consider whether to propose a tailored offering regime for certain crypto assets, including potential exemptions designed to make it easier for cryptocurrency businesses to raise capital.

The SEC attributed the cancellation to an unforeseen scheduling issue and had not announced a replacement date at the time of the decision.

While the meeting would not itself have introduced new binding rules, it was expected to begin the formal process of considering crypto-specific regulatory changes.

Its cancellation attracted additional attention because it came shortly after the Senate delayed progress on the CLARITY Act.

Bitcoin ETFs record weekly outflows

Institutional demand has also softened.

US spot Bitcoin ETFs recorded approximately US$389.7 million in net outflows between August 10 and August 14, with withdrawals recorded during 4 of the week's 5 trading sessions, according to data compiled from SoSoValue.

The largest individual fund outflows over the week included about US$153.2 million from Fidelity's FBTC, US$88.3 million from Grayscale's GBTC and US$79 million from BlackRock's IBIT.

The reversal follows periods of substantial institutional inflows into cryptocurrency investment products and provides another indication that investors have become more cautious.

Washington remains key for crypto markets

Bitcoin was trading around US$65,000 when the Senate delay emerged earlier in August before subsequently falling toward US$62,500 by August 14.

The cryptocurrency has since stabilised around US$63,000, but the combination of ETF withdrawals and uncertainty surrounding the US regulatory timetable has limited its ability to recover recent losses.

For investors, the developments underline how increasingly important Washington has become to cryptocurrency markets.

After years in which regulatory uncertainty was considered one of the sector's largest obstacles, expectations that the US would introduce a clearer digital asset framework helped underpin optimism across the industry.

The latest delays do not necessarily signal that reform has been abandoned, but they do mean investors may have to wait longer than expected for the regulatory clarity the sector has been seeking.
