Thailand’s Securities and Exchange Commission (SEC) has issued regulations governing the establishment and trading of cryptocurrency exchange-traded funds (ETFs), with the rules set to take effect on 16 October 2026. The rules aim to broaden investment opportunities, diversify Thailand’s capital market and strengthen the domestic crypto ETF ecosystem while maintaining investor protection.
Under the new rules, crypto ETFs must operate as passive investment vehicles tracking the price of an underlying crypto asset, with average net exposure to a single asset of at least 80% of net asset value over each accounting year. Initially, only Bitcoin and Ethereum will be eligible for investment. The funds must be listed and traded exclusively on the Stock Exchange of Thailand (SET), and their assets must be held by custodians licensed by the SEC.
Investors must acknowledge and confirm their understanding of the risks before trading, while securities firms will be prohibited from providing margin loans for crypto ETF purchases.
