Following the US Senate's failure to pass the Digital Asset Market Clarity Act (CLARITY Act, H.R. 3633) on September 15, 2026, the SEC and CFTC stepped up to build an interim regime using existing administrative authority.

Although institutions can still access Bitcoin, the absence of a federal law means there are fewer long-term guarantees regarding regulatory permanence.

Resolving the year's most consequential cryptocurrency vote took only a few minutes on the floor, but the political stalemate followed over a year of intense bipartisan negotiations.

The CLARITY Act had been stalled in Congress for months after passing the House in mid-2025. Even in the final days leading up to the September 15, 2026 procedural vote, negotiations over last-minute counterproposals continued right up until the vote was called.

The US Senate did not reject the concept of regulating cryptocurrency itself; both parties largely agreed on how to split market oversight between the SEC and CFTC.

Instead, the landmark bill failed a key procedural hurdle. Following the stalemate, the agencies began accelerating their own rulemaking processes to fill the regulatory gaps.

Falling 11 votes short of the 60 needed to commence discussion, the Senate's cloture vote on the CLARITY Act on September 15 finished with a score of 49 to 50.
