Le régulateur américain des valeurs mobilières, la SEC, a fait publier sa proposition de règle Regulation Crypto Assets dans le Federal Register le 21 août 2026. Un compte à rebours est lancé depuis ce jour : l'agence acceptera les commentaires sur celle-ci jusqu'au 20 octobre 2026. La proposition répond à la question sur laquelle la réglementation américaine des cryptos bute depuis des années, à savoir quand un jeton cesse d'être l'objet d'un contrat d'investissement. Pour vous, en tant que détenteur, rien ne change aujourd'hui, car le texte n'est pas encore une loi. Ce qui est fixé depuis la publication, c'est le calendrier, et c'est précisément cela l'actualité.

Ce qu'est la Regulation Crypto Assets et pourquoi le 20 octobre 2026 est important

La Regulation Crypto Assets est un ensemble de nouvelles règles que la SEC souhaite placer dans une section spécifique de la loi fédérale américaine. La proposition comporte deux axes : elle crée deux exemptions à l'obligation d'enregistrement pour les émetteurs, et elle décrit pour la première fois sous forme écrite les conditions dans lesquelles un jeton crypto n'est plus traité comme faisant partie d'un contrat d'investissement.

Le Federal Register est le journal officiel des agences fédérales américaines. Une proposition de règle n'y a pas encore de force contraignante, mais la publication déclenche la période pendant laquelle toute personne intéressée peut déposer des objections. Cette procédure est appelée notice and comment : l'agence présente un projet, recueille les commentaires et doit répondre aux objections substantielles dans la version finale.
