The U.S. Senate is set to hold a cloture vote on the Digital Asset Market Clarity Act at 2:15 p.m. ET on Tuesday, Sept. 15. The bill needs 60 votes to advance.

Cloture would not pass the bill. It would end debate on the motion to proceed and clear the way for the Senate to take it up.

A failed vote would leave little time to revive the legislation before the November midterm elections. The CLARITY Act is Congress's broadest attempt yet to divide oversight of digital assets between the Securities and Exchange Commission and the Commodity Futures Trading Commission.

What the bill would change

The bill would set rules for when a digital asset falls under the SEC and when it falls under the CFTC. Today, those boundaries are shaped largely by agency actions and court rulings rather than one federal statute.

The House passed H.R. 3633 in 2025. The Senate Banking Committee reported an amended version in June, and Senate Majority Leader John Thune filed cloture on the motion to proceed on Aug. 8, according to the bill's official congressional record.

The Senate schedule says the cloture motion will ripen at 2:15 p.m. ET on Sept. 15.
