TYLER, Texas (KLTV) - The Tyler Zoning Board of Adjustment has unanimously rejected an appeal for a proposed downtown cryptocurrency mining data center, ending a year-long dispute because the developer missed a critical filing deadline.

The board voted unanimously Thursday that it lacked the legal jurisdiction to hear the appeal from developer Barrio Resources LLC, which sought to challenge a June 2025 zoning decision requiring a special use permit for the facility at 1101 and 1105 West Erwin Street.

According to municipal records, Barrio Resources filed its appeal 364 days after the deadline. Texas state law caps the appeal window at 20 days, while Tyler’s Unified Development Code lists it as 30 days.

The jurisdictional battle had previously stalled during an earlier board meeting, where Barrio’s attorney, Jason Mozingo, argued that only the board itself—not city staff—had the authority to dismiss the case. Mozingo contended that the filing delay was a matter for the board to weigh during a hearing rather than grounds to block them from being heard entirely.

Barrio Resources had initially cooperated with the city’s requirements, applying for the special use permit under protest. However, after the city denied the permit in July, the developer attempted to appeal the original 2025 zoning classification.
