The US Senate’s failure to secure the 60 votes needed to advance the CLARITY Act is therefore less a rejection of regulation than a delay in deciding its details. The legislation remains on the agenda, but with relatively few working days left in 2026, another breakthrough this year becomes harder.
That matters because institutional investors do not particularly care whether crypto regulation is philosophically friendly. They care whether it is predictable.
Officially, the bill is “on ice” rather than completely dead. Senator Thom Tillis used a procedural maneuver to preserve the possibility of reconsidering it later. Congress might try to bring it back during the post-election “lame-duck” session. However, because lawmakers are leaving Washington to campaign for the upcoming midterm elections, time is incredibly tight.
Unresolved issues for crypto investors?
The unresolved issues are practical ones: the respective powers of federal and state regulators, treatment of stablecoin yields, banking safeguards and protections for software developers. The GENIUS Act has already established a framework for stablecoins, while the Securities and Exchange Commission and Commodity Futures Trading Commission retain some scope to provide clarity through rulemaking, exemptions and transitional measures.
