The SEC canceled its August 14 crypto rulemaking meeting with no new date confirmed. Nate Geraci, President of The ETF Store and co-founder of the ETF Institute, believes that may be a good sign for the CLARITY Act. The agency cited an “unforeseen scheduling issue.”

The meeting had been scheduled to propose Regulation Crypto, the SEC’s first formal rulemaking for digital assets. It was announced just four days prior on unusually short notice. The abrupt cancellation left the industry without the regulatory signal it had been anticipating.

Geraci’s Take On the Situation

Geraci suggested certain influential Senators may have come to their senses. His view is that those Senators recognized the SEC could and would move forward on crypto innovation regardless of Congressional action.

If that realization drove any behind-the-scenes pressure, it may signal renewed urgency around the CLARITY Act. Geraci’s position is that this development could bode well for the bill’s passage.

The SEC’s Posture

The SEC had made its intentions clear before the cancellation. Chair Paul Atkins stated the agency is “ready, willing, and able to come out with rules” whether Congress acts or not. Commissioner Hester Peirce echoed that position, confirming the SEC will advance work on custody, tokenized securities trading, and fundraising frameworks for crypto assets.

The SEC’s willingness to act independently removes Congress’s monopoly on crypto clarity. Senators who preferred legislative control over the crypto regulatory landscape now face a reality check. The SEC will not wait indefinitely.

The CLARITY Act’s Path Forward

The CLARITY Act has 53 Republican Senate votes locked in for cloture. It needs 60 to clear the filibuster. Between 7 and 10 Democrats are reportedly prepared to support the bill. The cloture vote is scheduled for September 15, 2026.

Senator Bernie Moreno stated that 11 months of negotiations have officially ended. He confirmed an agreement is in place and all parties are expected to honor their commitments. Senate Majority Leader John Thune filed cloture before the August recess, securing floor time when the Senate returns.

The Bigger Picture

The CLARITY Act would establish clear statutory lines between the SEC and CFTC over the crypto spot market. Legislation carries a durability that agency rulemaking does not. A future administration can reverse SEC rules, but a statute is far harder to undo.

Atkins acknowledged this himself, describing a statute as the way to future-proof the rules. The SEC’s own chair prefers Congressional action, and the cancellation of Friday’s meeting may reflect that preference playing out in real time.
