EU crypto regulation is moving into the core machinery of European financial markets. On October 9, the European Securities and Markets Authority opened a Call for Evidence. It examines whether central counterparties can safely use tokenized collateral. Stakeholders have until January 15, 2027, to respond.

The consultation does not authorize new collateral arrangements. Instead, it seeks practical evidence on whether digital systems can preserve protections required in central clearing. The review covers transfer, management, protection, and use across the collateral lifecycle.

ESMA wants to know how tokenized collateral could perform during market stress. It is also examining whether existing requirements can accommodate these arrangements. Legal certainty, liquidity, and operational controls must remain intact.

EU Crypto Regulation Review Targets Clearinghouse Collateral Risks

ESMA’s official consultation examined how tokenization affects assets throughout the clearing process. The regulator focused on collateral transfers, custody arrangements, ownership protections, and liquidation procedures.
