SEC, kripto arzlarını düzenleme biçiminde önemli bir değişiklik teklif ediyor.

18 Ağustos 2026'da Komisyon, kripto varlıkları içeren belirli arzlar için Menkul Kıymetler Yasası kaydından özel muafiyetler yaratacak yeni bir çerçeve olan “Kripto Varlık Düzenlemesi”ni teklif etti.

Başkan Paul Atkins, SEC'in kripto ile ilgili konulara yönelik geçmiş yaklaşımını “infaz yoluyla düzenleme” ve “kare bir pimi yuvarlak bir deliğe” sığdırma çabası olarak eleştirdi. Teklif edilen kurallar, mevcut menkul kıymet arzı çerçevesinin kripto işlemlerinin kendine özgü özelliklerine pek uygun olmadığının kabul edildiğini yansıtıyor. Bu çerçeveyi olduğu gibi uygulamak yerine teklif, federal menkul kıymetler yasalarına tabi olan arzlar için kriptoya özgü yollar yaratacaktır.

Teklif, SEC'in Mart 2026'daki yorumlayıcı rehberliğini takip ediyor ve Komisyonun kripto piyasalarına yönelik önceki infaz odaklı yaklaşımından uzaklaşmak için belki de şimdiye kadarki en net adımı işaret ediyor. Ayrıca, CLARITY Yasası Kongre'den geçerken gelmesiyle, kurum kural koyma sürecini ve yasama faaliyetlerini paralel yollara sokuyor.
