The US Senate's inability to pass the CLARITY Act might be the best thing that's happened to Bitcoin in months, at least according to the man whose company holds more of it than anyone else on the planet.
Michael Saylor, executive chairman of Strategy Inc. (the company formerly known as MicroStrategy), took to social media on September 16, 2026, arguing that the regulatory stall would actually accelerate institutional capital flows into Bitcoin. His logic: existing regulators already have the tools they need, and the absence of new rules removes the risk that Congress might write bad ones.
On September 15, the Senate held a cloture vote on the CLARITY Act. It failed 49-50, well short of the 60-vote threshold required to advance the legislation.
The bill, formally known as H.R. 3633, was designed to draw clear jurisdictional lines between the SEC and CFTC over digital assets. The CFTC would oversee digital commodities like Bitcoin, while the SEC would retain authority over tokens that function more like investment contracts.
The House had passed the bill with bipartisan support back in July 2025. The Senate Banking Committee moved it forward in May 2026. But negotiations over stablecoin provisions and ethics requirements ground the process to a halt, and the final vote reflected a chamber that couldn't agree on the fine print.
