What the Bill Would Have Done

The Clarity Act wasn’t just another crypto bill. It was the first serious attempt to create a comprehensive federal framework for digital assets — something the industry has demanded since Bitcoin went mainstream.

At its core, the legislation aimed to answer questions regulators have been arguing about for years: What’s a security? What’s a commodity? Who oversees what? The bill would have split authority between two agencies — the SEC (Securities and Exchange Commission) for investment-type tokens, and the CFTC (Commodity Futures Trading Commission) for everything else, including Bitcoin and most major cryptocurrencies.

The CFTC getting majority oversight was the industry’s preferred outcome. The CFTC is generally seen as a lighter-touch regulator compared to the SEC under recent chairs, and crypto firms have long argued that most tokens function more like commodities than securities. The bill would have given the CFTC explicit authority over crypto spot markets for the first time — a significant expansion of the agency’s mandate.
