SEC readies Reg Crypto

CoinDesk said the meeting follows the Senate’s failure to begin key votes on the Digital Asset Market Clarity Act before the August recess, and it framed the SEC’s move as a way to provide "regulatory certainty for crypto assets" after that delay.

CoinGape reported the meeting will begin at 10:00 AM ET and be open to the public, with visitors subjected to security checks and the meeting also open via webcast on the Commission’s website at the scheduled time.

CoinGape added that the SEC Division of Corporation Finance scheduled the meeting and listed staff members mentioned to attend as Jim Moloney, Sebastian Gomez Abero, Valian Afshar, Patrick Faller, John Fieldsend, and Irene Paik.

Clarity Act stalls, agencies move

CoinDesk described the Reg Crypto process as involving "a tailored offering regime for certain investment contracts" and said it is expected to give crypto firms a path to raise capital without triggering SEC registration requirements.

CoinGape said the SEC’s Reg Crypto effort aligns with Chair Paul Atkins’ vision and includes crypto startups’ registration exemption, fundraising exemption, and investment contract exemption, while also noting the meeting is aligned with the Clarity Act facing delay in the Senate.

CoinDesk quoted TD Cowen analyst Jaret Seiberg writing that the SEC’s action is "the first of several rulemakings the SEC will undertake to provide regulatory certainty for crypto assets" after the Senate failed before the August recess.

Bitcoin News reported TD Cowen’s policy memo dated August 10 by Garrett Saperstein assigning a 75% chance that CLARITY does not become law this fall, with the next Senate vote scheduled for September 15.

The Regulatory Review argued that a proposed rule would allow wealthy investors to unload crypto assets at the expense of average Americans, and it cited polling in which "roughly six-in-ten Americans (63%) say they have little to no confidence" in cryptocurrencies.
